This website, thewarmzy.com, is operated by FAKIFY LLC, trading as The Warmzy (FAKIFY LLC, 1200 N Federal Highway, Office 348, Boca Raton, FL 33432, United States). Throughout the site, the terms “we”, “us” and “our” refer to FAKIFY LLC. All contracts made through this website are concluded between you and FAKIFY LLC. The Warmzy offers this website, including all information, tools and services available from it, to you, the user, on the condition that you accept these terms, conditions, policies and notices.

By visiting our site and/or purchasing from us, you use our “Service” and agree to be bound by these terms and conditions (“Terms of Service”, “Terms”), including the additional terms and policies referred to here and/or available by hyperlink. These Terms apply to all users of the site. Please read them carefully before using our website. If you do not agree to these Terms, please do not use the website or our services.

Any new features or tools added to the store are also subject to these Terms. You can review the most current version at any time on this page. We may update, change or replace any part of these Terms by posting updates on our website; the Terms in force when you place an order apply to that order.

If you are a consumer, nothing in these Terms affects your statutory rights, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Card information is always encrypted during transfer over networks.

We work to keep the information on this site accurate and up to date, but the material is provided for general information and may occasionally contain errors. Product information that forms part of your contract with us (such as the description, price and main characteristics shown when you order) is binding as required by consumer law.

Section 4 – Modifications to the Service and prices

Prices for our products may change without notice, but changes will not affect orders that we have already accepted. All prices are in pounds sterling (GBP) and include VAT. We may modify or discontinue the Service (or any part of it) at any time.

Contract formation

The presentation of products in our online store is not a legally binding offer but an invitation to treat. By clicking the button to complete your purchase, you make a binding offer to buy the products in your basket. The automatic email confirming receipt of your order does not constitute acceptance. A contract is formed when we confirm dispatch of your order (shipping confirmation email).

Warranty

Statutory rights apply. Goods must be as described, of satisfactory quality and fit for purpose under the Consumer Rights Act 2015.

Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange in accordance with our Refund & Return Policy and your statutory rights.

We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your screen will display every colour accurately.

We may limit the sale of our products or Services to any person, geographic region or jurisdiction. We currently deliver only within the United Kingdom.

Section 6 – Accuracy of billing and account information

We may refuse or cancel any order you place with us, for example where a product is unavailable, a pricing error has occurred or we suspect fraud. We may limit or cancel quantities purchased per person, per household or per order. If we cancel an order after you have paid, we will refund you in full.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

Shipping address responsibility

You are responsible for providing accurate and complete shipping information at the time of purchase. If an incorrect or incomplete address is provided and the order has already been processed or shipped, we are not responsible for resulting delivery issues. If an order is returned to us because of incorrect address details, we can offer to re-dispatch it; additional shipping costs will be your responsibility. Your legal right to cancel is not affected.

Lost parcels

If an order is confirmed as lost in transit, we will send a replacement at no additional cost or, if you prefer, refund you in full.

We may provide you with access to third-party tools which we do not monitor or control. Your use of such tools is at your own discretion and subject to the terms of the relevant provider.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under English law, including your rights under the Consumer Rights Act 2015. We are not responsible for losses that were not foreseeable, or for business losses.

To the extent permitted by law, you agree to indemnify and hold harmless The Warmzy and our partners, officers, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand made by a third party arising from your breach of these Terms or your violation of any law or the rights of a third party.

Section 16 – Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by law and the remaining provisions shall continue in full force.

Section 17 – Termination

These Terms are effective unless and until terminated by you or us. You may terminate them at any time by notifying us that you no longer wish to use our Services. Termination does not affect orders already placed.

Section 18 – Entire agreement

These Terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and us regarding the Service.

Section 19 – Governing law

These Terms and any contract between us are governed by the laws of England and Wales. If you are a consumer, you may bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home nation, and you keep the protection of any mandatory consumer law of the part of the UK where you live.
